Raphaelle Davies secures almost £11,000 in settlement for mother suffering from PTSD after witnessing daughter’s injury

Our client, Mrs B, sadly witnessed an accident involving her daughter on 9th October 2022. A store sign fell off the wall and hit Mrs B’s daughter, striking her down to the ground, as they were walking along the pavement in town. Mrs B’s daughter sustained personal injuries, and Mrs B had to provide first aid by putting pressure on her daughter’s bleeding wounds whilst waiting for the ambulance to arrive.

After the incident, Mrs B could not sleep properly for the first week or so. She suffered with flashbacks for months and became very anxious and upset, particularly at the sight of blood or having to revisit the area of the accident. She was diagnosed with PTSD and received counselling.

The Defendant swiftly admitted to a breach of duty which led to the accident, however they requested further proof to show that their breach of duty caused Mrs B to develop her psychological injuries. A report was therefore obtained from a psychology expert which confirmed this to be the case. Our client has fortunately responded very well to the counselling and made a good recovery from her PTSD.

On the basis of this evidence, we submitted an initial settlement offer on behalf of Mrs B which was rejected, and a counteroffer was made by the Defendant which was significantly lower. Following a further exchange of settlement offers, it became clear that the insurers would not budge from their valuation which was, in our view, too low. It became necessary to issue Court proceedings as a result. Following service of the Court proceedings, the Defendant’s solicitors finally made a suitable increased offer and the claim reached a successful settlement in the sum of just under £11,000
