EP underwent an unnecessary sural nerve flap intended to reconstruct a defect in her leg following the removal of a soft tissue tumour. She developed worse pain in the immediate post-operative period and then developed chronic pain, a stiff ankle with reduced mobility and a poor cosmetic outcome.
As a consequence, she required an Achilles tendon lengthening procedure and needed to undergo revision surgery to her scar. There was no prospect of functional improvement, and she developed a moderate depressive episode which required treatment in the form of CBT from a psychiatrist.
The Defendant Trust denied both breach of duty and causation, however, following a further challenge and a period of negotiation, we were able to secure a settlement of £150,000 for our client.
